False-negative colonoscopy? Good malpractice article

Postby chrisca » Fri Dec 12, 2014 11:04 pm

For anyone who had a false-negative colonoscopy or other cancer test and later ended up with more aggressive treatment, or metastasis, the article below is one I wish I had read years ago:

Avoiding and Defending Malpractice Suits for Postcolonoscopy Cancer
http://www.medscape.com/viewarticle/808348

It is written from the perspective of doctors defending themselves, but that makes it even more useful. I am considering whether or not a malpractice suit is called for in my situation. At the very least, I now know a lot more about what the proper standard of care is. Anyone going in for a colonoscopy needs to ask the questions the article lists:

Quality of bowel prep
Rectal examination
Length of exam time and withdrawal time
Photography and video recording during exam
The doctor's detection rate
Followup evaluation measures (VERY IMPORTANT!)
Male, false negative colonoscopy age 48
DX: 12/2010 rectal cancer age 51
Stage T3N0M0 2 cm from anal verge
neoadjuvant rad/chemo Xeloda
Rectal resection (open surgery) straight anastomosis
Xeloda round 2
ileostomy reversal 11/2011
Successful adhesion X-lap 8/2013
Ongoing LAR syndrome but NED 10 years
